Terms of Service

By accessing or using goBuildy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and goBuildy. We may update these Terms from time to time; continued use of the Service after we notify you of changes constitutes acceptance of the updated Terms.

goBuildy is an AI-powered website generation service. You describe your business in plain language, and our system uses artificial intelligence to generate a professional website for you. The generated site is hosted on goBuildy's infrastructure and delivered to your visitors.

The Service is currently available in the United States only.

The websites generated by goBuildy are produced by large language models (LLMs) including Google Gemini and Anthropic Claude. By using the Service, you understand and agree to the following:

• AI content is not professional advice. Nothing in an AI-generated site constitutes legal, medical, financial, tax, or other professional advice. If your business requires such advice, consult a licensed professional.
• AI content may contain errors. LLMs can produce inaccurate, incomplete, or outdated information. You are responsible for reviewing, editing, and verifying all content on your generated site before publishing it to real customers.
• You are responsible for your site's content. By completing checkout and deploying your site, you confirm that the site's content does not violate any applicable laws or third-party rights (see Section 7 — Acceptable Use).
• AI model routing. goBuildy selects the AI model used to generate your site based on availability and load. The specific model used is not guaranteed and may change without notice.

When goBuildy registers a domain on your behalf, the following terms apply:

• You are the registered owner. Your ICANN registrant contact information is filed with the domain registry. WHOIS privacy protection is enabled by default, hiding your personal details from public lookups. You may opt out of WHOIS privacy at any time.
• The domain is held in goBuildy's AWS account. This is a custody arrangement, not a transfer of legal ownership to goBuildy. goBuildy acts purely as a registration gateway on your behalf.
• Transfer-out is always available. You may request a domain transfer to another registrar at any time via our contact form. We will provide an auth code within 2 business days. Transfers follow the standard 5–7 day ICANN process.
• Auto-renewal. Domains are set to auto-renew annually. You will be charged the prevailing Route 53 renewal price for your domain's TLD at the start of each renewal year. If your goBuildy subscription is cancelled before renewal, we will disable auto-renewal and notify you with transfer-out instructions.

Before purchasing a plan, you receive a 72-hour free preview of your AI-generated site at a temporary URL. The preview is watermarked and will be permanently deleted after 72 hours or when the preview token expires, whichever comes first.

The free preview does not constitute a guarantee that your final published site will be identical in appearance or content — minor differences may occur during provisioning.

After your first free site generation, a refundable $1 design deposit is required to unlock additional regenerations or to proceed with publishing. The following terms apply to the deposit:

• Authorization, not charge. The $1 deposit is a card authorization hold authorized through our payment processor. Your card is not charged at the time of authorization — the hold simply verifies that a valid payment method is on file.
• Credited on publish. If you purchase a goBuildy subscription within 72 hours of authorizing the deposit, the $1 is captured and immediately applied as a credit against your first month's subscription invoice. You are not double-charged.
• Automatic release. If you do not purchase a subscription within 72 hours of authorization, the hold is automatically voided and released in full. No charge appears on your statement. Depending on your card issuer, the pending hold may take 3–7 business days to disappear from your balance.
• No subscription commitment. Authorizing the $1 deposit does not create a subscription or any recurring payment obligation. It only unlocks additional AI regeneration attempts during your 72-hour free preview window.
• Non-refundable after capture. Once captured (i.e., you completed a subscription purchase), the $1 is applied as a credit and is non-refundable as a standalone item. The credit remains on your account and reduces your first invoice.

You agree not to use the Service to generate or host content that:

• Is illegal under applicable federal, state, or local law.
• Infringes any copyright, trademark, trade secret, patent, or other intellectual property right.
• Is defamatory, harassing, abusive, or threatening toward any individual or group.
• Constitutes spam, phishing, or any form of deceptive marketing.
• Depicts or promotes child sexual abuse material (CSAM) — zero tolerance, reported to NCMEC immediately.
• Facilitates unlicensed financial services, gambling, or the sale of illegal substances.
• Impersonates another person, business, or government entity.

goBuildy reserves the right to remove any site that violates these terms without notice and without refund, and to report relevant content or activity to law enforcement.

goBuildy may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. In the event of termination for cause, no refund is owed.

You may cancel your subscription at any time from your account dashboard. Upon cancellation, your site will remain live until the end of your paid billing period, after which it will be taken offline and your data will be deleted per our Privacy Policy retention schedule.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOBUILDY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOBUILDY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO GOBUILDY IN THE 3 MONTHS PRECEDING THE CLAIM.

GOBUILDY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.

If you believe that content on a goBuildy-hosted site infringes your copyright, submit a DMCA takedown notice via our contact form with: (1) identification of the copyrighted work; (2) the URL of the infringing content; (3) your contact information; (4) a statement of good faith belief; (5) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized agent; and (6) your physical or electronic signature.

These Terms are governed by the laws of the United States applicable to agreements made and performed entirely within the United States, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration under JAMS rules, with proceedings conducted in English. Class actions are waived to the fullest extent permitted by law.

goBuildy is administered by an individual. The information below is published in accordance with the requirements of the payment processors we operate with.
